1. Scope
These general conditions are intended to regulate the Terms and Conditions of Use governing the provision by Associação Porto Business School (PBS) -U.Porto, a non-profit association, with its registered office at Avenida Fabril do Norte, n. 425, parish of Senhora da Hora, municipality of Matosinhos, with postal code 4460-332, and holder of tax identification number 508 541 832. º 425, freguesia da Senhora da Hora, concelho de Matosinhos, com código postal 4460-314 and holder of tax identification number 508 541 832, hereinafter referred to as “Porto Business School”) of certain services to authenticated users of the website operated by it and the personal data protection policy associated with this service.
2. Intellectual property
2.1. All materials, content and software available on the website, namely information, images, illustrations, graphics, names and logos are the intellectual property of Porto Business School or third parties, and may not be reproduced, modified, distributed, marketed, or used in any other way, unless prior and express written authorization has been given by Porto Business School or the third parties holding the intellectual property rights over them.
2.2. Any use of the materials, content and software available on the website for a purpose other than that expressly permitted by these Terms and Conditions of Use will be considered a violation of current national and international copyright legislation.
3. User responsibility
3.1. Porto Business School is not responsible for the accuracy of any information, image, contribution or other material that users provide through the use of the website.
3.2 The User undertakes to make prudent, careful and responsible use of the website, and not to use it in a way that may imply the violation of rights or legally protected positions of Porto Business School or third parties.
3.3 The User will indemnify Porto Business School for any claims, sanctions, fines, sentences or embargoes that result from non-compliance with intellectual and industrial property laws in the use of the website, as well as any damage caused to third parties whose fault or negligence is attributable to the User.
3.4. The User is solely responsible for any damage or loss, including loss of data, caused to their computer system and/or equipment resulting from the use of the materials, content or software available on the website, unless they prove that they were caused intentionally or with serious negligence by Porto Business School.
3.5. Porto Business School shall not be liable for any damages that may result from (i) the operation of the User’s computer system and/or equipment, (ii) difficulties in using the website caused, in particular, by delays, interruptions, errors, interference or suspension of communications, viruses, bugs or malfunctions, (iii) delays caused by deficiencies or overloads of Internet traffic or other electronic systems, (iv) illegitimate actions by third parties, errors or security deficiencies caused by the use of outdated or insecure equipment or browsers, failures of the electronic communications services used by the User, as well as damages, errors and inaccuracies that may result from their malfunction.
4. Protection of Personal Data
Porto Business School guarantees the processing of personal data in accordance with the legislation in force regarding its collection, processing, use, disclosure, storage and privacy, under the terms of its Privacy and Processing of Personal Data Policy.
5. Links
5.1. Porto Business School is not responsible for the legality, reliability or quality of any content made available on a web page to which a link is made available on its website.
5.2. The provision of links on the website does not in any way imply the existence of any relationship between Porto Business School and the owner or manager of the web page to which the link refers, or the consent of Porto Business School to any materials, content or software made available there.
6. Cookies
Porto Business School may use cookies on this website to improve the quality of service, features provided, and user experience, and are not used for profiling. 7. Jurisdiction and communications
7.1. These Terms and Conditions of Use are governed by Portuguese law.
7.2. The parties hereby agree to submit any dispute arising from its interpretation or application to the jurisdiction of the Matosinhos district court, expressly waiving any other jurisdiction.
8. Use
8.1. The website may be used by ordinary users, without registration and unregistered browsers, and by Authenticated Users, users who are granted access to the reserved support area (Student/Teacher Portal) on account of a previously established support contractual relationship in force with Porto Business School.
8.2. Authentication consists of identifying the User by entering a user ID and password, which are mandatory fields to be filled in when registering as an Authenticated User.
8.3. The password chosen by the User is personal and non-transferable, and any assignment or communication to unauthorized third parties is prohibited.
8.4. Whenever the Authenticated User becomes aware that their user data is being used by third parties, they must immediately notify Porto Business School.
8.5. Notwithstanding the existing contractual relationship with the Authenticated User, Porto Business School may, for security reasons and to safeguard the privacy of communications, restrict or limit access to Authenticated Users.
